State Question 6: Right to abortion (Initiative Petition C-05-2023)

Would add a fundamental right to abortion to the Nevada Constitution, until fetal viability or when needed to protect the pregnant person's life or health, which state and local governments could limit only for a compelling state interest as defined in the measure. Existing state law already allows abortion up to 24 weeks. A constitutional amendment proposed by initiative must be approved at two consecutive general elections; this question was approved in 2024 and is on the 2026 ballot for the second vote.

What a vote means

A yes vote
Official explanation: A “Yes” vote would create a new section of the Nevada Constitution to establish a person’s constitutional right to abortion, so that a person can make decisions about matters relating to abortion and reproductive healthcare, without interference from state or local governments.
A no vote
Official explanation: A “No” vote would keep the Nevada Constitution in its current form and would not impact the availability of abortion as a statutory right under Nevada law.
